DARBC members seek clarity on CDA writ of execution, await next move

Members of the Dolefil Agrarian Reform Beneficiaries Cooperative (DARBC) in Polomolok, South Cotabato, are seeking clarification from the Cooperative Development Authority (CDA) on the status of the writ of execution issued on February 24, 2026.

They want to know whether the writ can already be implemented and what steps the agency is taking to enforce its decision.

The case has reportedly reached the Court of Appeals (CA), raising questions about the possible impact of the proceedings on the implementation of the CDA order.

The filing of a case before the CA does not automatically suspend enforcement. The effect depends on the court’s specific orders and the scope of any injunction it may have issued.

The CDA is being urged to clarify whether the writ remains enforceable or whether any legal restriction prevents its implementation.

A DARBC member said the agency should explain the next steps if enforcement is allowed. If implementation has been suspended or restricted, the legal basis should also be clarified.

The member said the clarification is important to DARBC members whose rights and interests may be affected by the dispute. All parties should be given a fair opportunity to present their positions and have the matter resolved through the proper legal process.

He added that members are awaiting the CDA’s official explanation on the status of the writ and the appropriate action in accordance with the law and any applicable court orders.
